Murder of an infant (u/s 302 of the Penal Code, 1860)
Brief Description
A twenty-five-day-old newborn named Yazdan Irik Zayan died mysteriously in a flat in Kalabagan on May 1, 2023. A week after this incident, the mother of the child, Sultana Yasmin alias Mahi, claimed through the media and social media that she came to know through the power of the jinn that the housemaid Morjina had killed the child. Thereafter, the child’s mother filed a murder case in the court accusing four people, including her ex-husband and housemaid Morjina, of killing Jayan.
Investigation
According to the sources, he ordered the OC of Kalabagan police station to submit all the information regarding the child’s death to the court by September 10 last year. But as the investigation process of the case was not completed within the time prescribed by the court, the police submitted a full report to the court on December 23 last year. On the day of hearing on January 10, the court dismissed the proceedings in a summary order and ordered the release of three other accused including Morjina.

Morjina’s lawyer, Advocate SM Tasmirul Islam Uday, said that the case has started with several fundamental errors. There is no consistency in the narrative of the two cases of the same incident. Besides, all the statements given by the complainant at various times are contradictory to the facts described in the case. There is no match between the description of the complainant and the cause mentioned in the death certificate of the newborn child. The cause of death was listed as intracranial hemorrhage, aspiration pneumonia, which usually occurs when food enters the airways, and bleeding in the respiratory tract.
Court Order
The Chief Metropolitan Court, Dhaka has ordered the dismissal of the murder case filed on the charge of killing a newborn in the capital’s Kala Bagan. In the investigation report of the case (filed by the infant’s mother accusing four people including the ex-husband and the housemaid), the housemaid Morjina Akhter was discharged as no involvement was found.
